After receiving a response to his enquiry via the state system e-Otinish, a citizen discovered among the files sent to him an internal document that related to a completely different enquiry. The document contained information about third parties unrelated to his case.
HOW THE APPLICANT DISCOVERED THE EXTRANEOUS DOCUMENT
According to information received by the FBK editorial office, the applicant submitted one of his enquiries to the Prosecutor General's Office of the Republic of Kazakhstan. The materials were subsequently registered in the Unified Information and Analytical System (UIAS) «Қадағалау» and forwarded for consideration according to jurisdiction.
According to the applicant, along with the covering letter regarding his enquiry, he received another document which was unrelated to the subject of his complaint.
The author of the enquiry claims this was an internal covering letter containing information pertaining to another enquiry. He states that the document included the details of the applicant and the person against whom the enquiry was made.
The citizen further asserts that he received the document solely through the official e-Otinish service, and not as a result of any independent actions on his part to seek or obtain it.
A COMPLAINT HAS ALREADY BEEN SENT TO THE PROSECUTOR GENERAL'S OFFICE
After discovering the extraneous document, the applicant submitted a separate complaint to the Prosecutor General's Office of the Republic of Kazakhstan.
In it, he requests that an internal investigation be conducted into the circumstances of the incident, that an assessment be made of the actions of the officials who allowed the erroneous transmission of the document, and that compliance with legal requirements regarding the handling of personal data be verified.
WHY THIS STORY DESERVES ATTENTION
The FBK editorial office is deliberately not publishing the document itself and is not disclosing information that could identify the individuals mentioned within it.
Nevertheless, the situation described raises the question of how reliably the electronic document management system operates when handling citizens' enquiries. The authorised bodies must provide the final assessment of the circumstances of the incident and whether or not any violations have occurred, based on the outcome of the investigation.
