The conflict around the dacha cooperative in Shchuchinsk received official outcomes within a few days: the investigation closed the case of possible fraud, the court refused the claim on the legality of the chairman's appointment, and the second claim was left without consideration. The dispute, which had been running on social media since spring and had reached appeals to the President, received a procedural result.

WHAT THE INVESTIGATION AND COURTS DECIDED

According to the ruling on the termination of the pre-trial investigation and the decisions of the Burabay District Court of Akmola Region, the outcomes in the case of the "Shchuchinsk Voluntary Society of Amateur Gardeners" ("Shchuchinsk VSAG") were summarised from 29 September to 1 October 2026.

On 30 July 2026, on the application of Gulmira Egiyeva, a case was registered under Part 3 of Article 190 of the Criminal Code of the Republic of Kazakhstan ("Fraud"). The applicant reported the possible unlawful disposal of the cooperative members' money by its chairman, Bakhtiyar Gabdullin. On 29 September, the investigator terminated the investigation under paragraph 2 of part 1 of Article 35 of the Criminal Procedure Code of the Republic of Kazakhstan ("Absence of the elements of a criminal offence"), and on 1 October the ruling was approved by the Deputy Prosecutor of Burabay District. The document states that deception, mercenary intent and a specific victim were not established.

On 30 September, the court refused Gulmira Egiyeva's claim to invalidate the board minutes of 25 April 2019, by which the chairman was appointed, and awarded 125,000 tenge in court costs against her. The decision may be appealed within a month. On 1 October, the court left without consideration her second claim, challenging the decisions of the meeting of 2 August 2026: the application for this was filed by the claimant herself. According to the editorial team, on 26 September the general meeting of the cooperative expelled Gulmira Egiyeva from the membership of the society.

WHAT FBRK PREVIOUSLY WROTE ABOUT THE CONFLICT

In a May article, the FBRK editorial team reported how, at the end of April, publications about extortion and the lack of accounting in the cooperative appeared on social media. We visited the plots and spoke with the dacha owners. They recalled the power lines, lighting, new water supply and security that had appeared over the years of the current leadership's work, and said they had no complaints. Egiyeva, soon after joining the cooperative, demanded accounting on an individual basis, bypassing the general meeting. The editorial team found no confirmation of her key accusations.

In an August article, FBRK described how the conflict reached appeals to the President: on 28 July, Egiyeva published a video and reported that her application to the prosecutor's office had not been accepted. At the meeting on 2 August, where FBRK journalists were present, she publicly apologised only for video-recording the spring meeting without the participants' consent, and then published a video with a different interpretation of the events.

LAW AND ORDER AS A GUIDING PRINCIPLE

President Kassym-Jomart Tokayev calls the principle of "Law and Order" the ideological and political guiding principle of society and notes that it is enshrined in the new Constitution. The Constitution was adopted at the referendum on 15 March 2026.

The conflict in the cooperative unfolded against the backdrop of the elections to the Kurultai on 23 August 2026, in which the party "Ädilet" gained 71.17% of the votes and received 110 mandates.

The FBRK editorial team believes that the outcomes correspond to the conclusions of its articles: the dispute over the cooperative's activities is being resolved through the procedures provided for by law.

WHAT REMAINED OUTSIDE THE DECISIONS

A judicial economic expert examination identified violations in the keeping of accounting and cash documentation and could not reliably determine the expenditure of money from the cash desk, but did not establish a fact of embezzlement. The court decision of 30 September has not entered into legal force.
