The Astana Department of the Agency for the Protection and Development of Competition (APDC) has identified signs of antitrust legislation violations in the activities of JSC "National Centre for Expertise and Certification" ("NaCEkS"). After receiving the notification, the organisation complied with the requirements and took measures to prevent the application of different prices for equivalent services.
WHAT THE INSPECTION REVEALED
During the inspection, it was established that JSC "NaCEkS" applied different prices for identical metrological verification services without objectively justified reasons. The cost of verifying the same equipment varied depending on the client, while actual pricing was not carried out on the basis of the approved price list.
WHAT VIOLATIONS THE APDC IDENTIFIED
In the actions of JSC "NaCEkS", the APDC identified signs of abuse of a dominant position, as provided for in subparagraph 2 of Article 174 of the Entrepreneurial Code of the Republic of Kazakhstan. In this regard, in accordance with Article 199 of the Entrepreneurial Code of the Republic of Kazakhstan, the department issued a notification to the organisation regarding the presence of signs of violations of legislation in the field of competition protection.
WHAT MEASURES THE ORGANISATION TOOK
It is reported that the notification was complied with. In addition, JSC "NaCEkS" took measures to prevent the application of different prices when providing equivalent services.
