The Court of Cassation changed the sentence imposed on three residents of the Atyrau Region who were found guilty of using violence against representatives of authority. Instead of restriction of liberty, they were sentenced to imprisonment.
HOW THE SENTENCE WAS CHANGED
According to the General Prosecutor's Office, the cassation instance reviewed the protest filed by the Deputy General Prosecutor and concluded that the punishment previously imposed did not correspond to the gravity of the offences committed.
The Kyzylkoga District Court had previously sentenced B. and A. to 4 years of restriction of liberty each, and Zh. to 3 years and 6 months of restriction of liberty.
Following the review, B. and A. each received 4 years of imprisonment, and Zh. received 3 years and 6 months of imprisonment. The convicted individuals were taken into custody in the courtroom.
WHY THE COURT OF CASSATION CHANGED THE SENTENCE
The cassation panel noted that the actions of the convicted individuals posed an increased public danger, as they disrupted public order and caused harm to the health of a police officer while he was performing his official duties.
The court deemed the previously imposed restriction of liberty unjust and replaced it with imprisonment.
CONTEXT
The case concerns an incident that took place on 3 April at approximately 22:00 in the Makat District of the Atyrau Region. While carrying out their official duties, police officers encountered aggressive behaviour from a group of citizens.
According to the investigation's version of events, a group of men in a state of alcohol intoxication actively resisted the police officers who had arrived in response to a call.
During the incident, the representatives of authority were kicked. Additionally, according to the investigation, the men used a wooden stick and a stone. One of the police officers sustained bodily injuries of moderate severity.
A criminal case was opened in connection with the incident under Article 380 of the Criminal Code of the Republic of Kazakhstan ("Threat or violent acts against a representative of authority").
