President Kassym-Jomart Tokayev has appointed Alibek Moldagaliyev as chair of the Aktobe Regional Court. His appointment came just weeks after a presidential decree terminated the honorary retirement of his father — Moldabek Akhmetov, who lost his retired judge status following a review of his case by the Commission on Judicial Ethics.

WHAT IS KNOWN ABOUT THE APPOINTMENT

According to Hronika.kz, Kassym-Jomart Tokayev appointed Alibek Moldagaliyev as chair of the Aktobe Regional Court by decree dated 29 July. By the same decree, he was relieved of his post as chair of the criminal cases judicial panel of that court.

It is reported that on 1 August, the Chair of the Supreme Court, Aslambek Mergaliyev, will introduce the new head to local judges.

WHAT IS KNOWN ABOUT THE FATHER'S SITUATION

On 9 June, the President terminated by decree the honorary retirement of Alibek Moldagaliyev's father — Moldabek Akhmetov.

It is reported that Moldabek Akhmetov entered honorary retirement from his post as a judge of the Kyzylorda Regional Court under a presidential decree of 4 May 2018, No. 680. After retiring, he engaged in legal practice and represented the interests of citizens in courts.

WHY THE HONORARY RETIREMENT WAS TERMINATED

The grounds for reviewing Moldabek Akhmetov's status were his actions towards a private bailiff during enforcement proceedings.

The Commission's materials state that during a conversation with the bailiff, Akhmetov made offensive remarks and displayed aggressive behaviour. After the bailiff began recording video, Akhmetov snatched his mobile phone and smashed it on the floor in front of witnesses.

Following consideration of the complaint, the Commission on Judicial Ethics of the Kyzylorda Region found that Akhmetov had committed a misconduct incompatible with the requirements of judicial ethics.

WHAT CONSEQUENCES FOLLOWED

Following the termination of his honorary retirement, Moldabek Akhmetov lost his judge status, his lifelong monthly allowance of 500,000 tenge, as well as the guarantees provided for under the Constitutional Act "On the Judicial System and Status of Judges of the Republic of Kazakhstan".

At the same time, the 24 official salaries he received upon retirement are not subject to repayment to the state.
