The Aktobe court recovered 393 million tenge from the head of «ZHAN-AMI and K» LLP for processing 1,400 tonnes of hazardous waste

The director of Zhan-Ami and K LLP in Aktobe was convicted of processing more than 1,400 tonnes of hazardous oil waste without a state licence. The enterprise received 393 million tenge from this activity, which the court ordered to be recovered as state revenue.

HOW THE ILLEGAL PROCESSING WAS DISCOVERED

According to the Aktobe Region Prosecutor's Office, an inspection established that in 2024–2025 Zhan-Ami and K LLP was processing hazardous oil waste without the required state licence.

During this period, the enterprise received income of 393 million tenge. Based on materials from the Aktobe Region Environmental Prosecutor's Office, a pre-trial investigation was registered, which was conducted by the Department of Economic Investigations (DEI).

WHAT PUNISHMENT THE COURT IMPOSED

On 17 August, Aktobe City Court No. 2 found the director of the LLP guilty of committing a criminal offence under 

paragraph 2 of part 2 of Article 214 of the Criminal Code of the Republic of Kazakhstan ("Illegal entrepreneurship involving the receipt of income on an especially large scale").

The court sentenced the director to 2 years and 6 months of restriction of liberty with confiscation of property. At the same time, on the basis of the Law "On Amnesty", the convicted person was released from the main punishment.

WHAT THE COURT DECIDED REGARDING THE ILLEGAL INCOME

Release from the main punishment did not cancel the recovery of the income received by the enterprise. The court ordered the recovery of 393 million tenge as state revenue.

The appellate instance left the sentence unchanged. It entered into legal force.

CONTEXT

Earlier, Eco-Mangistau LLP was fined 1.73 million tenge for violations of the rules on handling industrial waste and the requirements of environmental legislation. An inspection revealed the underground burial of 17,694.32 tonnes of unprocessed waste, disturbance of the soil layer and construction work carried out without the necessary environmental permits.
